Terms of Service: Apex Marine Labs
Last updated: 23 October 2026
1. Who we are
This store is operated by Rahib Mouad, EI, an individual entrepreneur (entrepreneur individuel) established in France under the French micro-entreprise scheme, trading as Apex Marine Labs, registered in the Paris Trade and Companies Register (RCS Paris 131 708 315), SIRET 131 708 315 00018, with its registered business address at 173 rue de Courcelles, 75017 Paris, France. VAT: not applicable, French VAT exemption for small businesses (TVA non applicable, art. 293 B du CGI).
Throughout these terms, "Apex Marine Labs", "we", "us" and "our" all mean the business described above. "You" means the person buying from or using this store.
Your contract for any order placed on this store is with Apex Marine Labs. Payments are processed in that name, and it is the business against which any right under these terms, under our Refund and Cancellation Policy, or under the consumer law of your country, is exercised.
Contact: support@apexmarinelabs.com, telephone +1 307 430 1974. Our full legal notice is on our Legal notice page.
2. What these terms cover
These terms apply every time you browse this store or place an order. By placing an order you accept them. Our Refund and Cancellation Policy and our Privacy Policy form part of these terms.
If any part of these terms conflicts with a right you have under the consumer law where you live, that law applies and this document gives way to it.
3. What we sell
We sell digital documents: interactive PDF records, registers, logs and worksheets for boat owners, delivered as downloads in A4 and US Letter. We sell no physical goods and provide no services beyond the supply of these documents and support relating to them.
Each product page states the number of pages, the number of interactive form fields, and what the document contains. Those figures are accurate for the edition on sale. Each product page also names the apps in which the Fillable edition has been tested. We make no promise about apps that are not named.
4. What our documents are not
Our documents record and organise information that you supply. They publish no threshold, no tolerance, no service interval, no rate and no requirement, and they reach no conclusion about any vessel, system or situation.
They are not a marine survey, a service manual, a training course, medical advice, legal advice, insurance advice, or financial, tax or accounting advice. They do not replace a qualified surveyor, engineer, rigger, sailmaker, practitioner, lawyer, broker or accountant, and they do not relieve the person in charge of a vessel of any judgement that is theirs to make.
You remain solely responsible for the figures you enter, for the decisions you take, and for the safety of your vessel and the people aboard.
5. Eligibility and ordering
You must be at least 18 years old and able to enter a binding contract. You must give accurate billing and contact details: your download links go to the email address you provide.
How to order: add documents to your cart, go to checkout, enter your email and billing details, choose a payment method, then review your order. Before you pay, the checkout shows a summary of what you are buying and the total price, and you can go back to correct any detail or remove any item. Your order is placed when you click the final payment button. The contract is concluded in English.
Your order is an offer to buy. The contract forms when we send your order confirmation and your download links. We keep a record of your order, and your confirmation email is your copy of it. These terms stay available at all times through the Terms of service link at the foot of every page of this store, so you can read, save or print them before you order.
Your right of withdrawal: as a consumer, whatever country you live in, you may withdraw from your purchase within 14 days of your order, without giving a reason, and receive a full refund. You can do it online on our Withdraw from a purchase page, or by email. If a step at checkout ever asks you to give up this right in return for immediate access, that step applies only if you accept it and we confirm it in your order confirmation. After the 14 days, we do not refund a change of mind, and a file that is faulty or not as described is always replaced or refunded. Sections 2 to 4 of our Refund and Cancellation Policy explain all of this.
We may decline or cancel an order, and refund it in full, where we suspect fraud, where a payment is disputed or reversed, or where an order breaches these terms.
6. Prices, currency and taxes
All prices are shown and charged in United States dollars (USD). Your bank or card issuer may apply its own conversion rate and fees, which are outside our control.
Payment is taken in full when you place your order, through Shopify Payments, by the methods shown at checkout (such as card, Shop Pay, Apple Pay or PayPal).
Prices include any tax we are required to collect. Where no such tax applies, the price shown is the price you pay. French VAT is not applicable to our sales under the French VAT exemption for small businesses (TVA non applicable, art. 293 B du CGI). Prices may change at any time, but the price displayed when you order is the price that applies to that order.
7. Delivery
Download links appear on screen immediately after payment and are emailed, usually within a few minutes. Keep your order confirmation email: it is how you retrieve your documents. If a link stops working, email us with your order number and we will resend it.
If your links do not arrive, check the spam folder first, then email support@apexmarinelabs.com with your order number. We will resend them.
8. Your licence to use what you buy
When you buy a document, you do not buy the copyright in it. You receive a perpetual, non-exclusive, non-transferable licence for a single owner, vessel or crew.
Buying as a gift: if you buy a document as a gift, you may pass this licence on once, intact and in full, to the person who receives the gift. That person then becomes the licence holder, for their own vessel and on these same terms, and you keep no right to use the document yourself. This is the only transfer the licence allows.
You may: store the file on any device you own, print it as many times as you like, complete it, keep it for as long as you wish, and supply a completed copy to your surveyor, engineer, yard, broker, insurer, charterer or buyer as part of a real transaction concerning your own vessel.
You may not: redistribute the blank document, resell it, publish it, share it on any public or private network, include it in any other product, use it to provide a commercial service to third parties, or use it to train any machine learning or artificial intelligence system.
If you are a professional, such as a surveyor, a yard, a charter operator or a school, and wish to use our documents across multiple client vessels, contact us for a licence that permits it. The standard licence does not.
9. Intellectual property
The documents, their structure, their calculation models, the text of this store, the product photography, the Apex Marine Labs name and logo all remain our property or that of our licensors. Nothing you buy transfers any of it to you.
10. Acceptable use of this store
You agree not to attempt to gain unauthorised access to any part of this store, to interfere with its operation, to scrape it systematically, or to use it for any unlawful purpose.
11. Disclaimers
To the extent permitted by law, and subject always to section 12, our documents are supplied "as is". We do not warrant that they will be suitable for any particular vessel, that they will meet any regulatory requirement applicable to you, or that their use will produce any particular outcome.
12. Consumer guarantees that cannot be excluded
Nothing in these terms excludes, restricts or modifies:
- the legal guarantee of conformity for digital content under articles L. 224-25-1 and following of the French Consumer Code, and the guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, summarised in the box below;
- any guarantee under the Australian Consumer Law that cannot be excluded;
- any guarantee under the New Zealand Consumer Guarantees Act 1993 that cannot be excluded;
- any right under the consumer protection law of a Canadian province or a United States state that cannot be excluded;
and nothing in sections 11 or 13 applies to the extent it would have that effect. Where those laws give you a remedy, that remedy is available to you regardless of anything else in this document.
Legal guarantee of conformity for digital content (French Consumer Code)
You have two years from the supply of a document to claim the legal guarantee of conformity. For a defect that appears within one year of supply, you only need to show that the defect exists, not when it appeared.
Under this guarantee, we must supply any update needed to keep the document in conformity, and you may ask us to bring the document into conformity, free of charge, without undue delay and without major inconvenience to you.
You may instead obtain a price reduction while keeping the document, or end the contract and receive a full refund, in particular if we refuse to bring the document into conformity, if we delay doing so without reason, if it cannot be done without cost or major inconvenience to you, or if the defect remains after we tried. If the defect is so serious that it justifies it, you may ask straight away for a price reduction or for the contract to end, without first asking us to fix it. The contract cannot be ended for a minor defect.
These rights come from articles L. 224-25-1 to L. 224-25-31 of the French Consumer Code. A trader who obstructs the legal guarantee in bad faith is liable to a civil fine of up to 300,000 euros, which may be raised to 10% of average annual turnover (article L. 242-18-1 of the French Consumer Code).
You also benefit from the guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for two years from the discovery of the defect. Under that guarantee you may choose a price reduction or the end of the contract with a refund.
13. Limitation of liability
Subject to section 12, and to the extent permitted by law, our total liability arising out of or in connection with any order is limited to the amount you paid for that order.
Subject to section 12, we are not liable for indirect or consequential loss, for loss of profit, for loss of a vessel or its value, or for any loss arising from a decision you took using a document you completed.
14. If something goes wrong
Email support@apexmarinelabs.com with your order number and a description. We aim to reply within two business days and to resolve every issue without either of us needing to involve anyone else. Contacting us first does not prevent you from using any right or remedy the law gives you, including contacting the consumer protection authority where you live.
15. Governing law
These terms are governed by French law. Subject to the paragraph below, the courts of France have jurisdiction.
This does not deprive you of the protection of the mandatory consumer law of the country where you live, or of the right to bring proceedings in your local courts where that law gives you that right. Australian and New Zealand consumers keep the full benefit of sections 5 and 6 of our Refund and Cancellation Policy and section 12 above.
16. Changes to these terms
We may update these terms. The version in force when you place an order is the version that governs that order. The date at the top shows when this version was published.
17. Severability
If any provision of these terms is held to be unenforceable, the rest continues to apply.
